I. Welcome to Sophie's Stems

Thank you for choosing Sophie's Stems. We are delighted to have you here. We are committed to offering premium products and attentive service. Please take a moment to review these Terms of Service ("Agreement") which govern the use of our website, www.sophiestems.com.

By placing an order with Sophie's Stems, you enter into a legally binding agreement. This Agreement applies to all products and services we offer. Any personal information collected from you is subject to our Privacy Policy, which is included as part of this Agreement.

This Agreement is governed by the laws of the State of Oregon. Any legal claims against Sophie's Stems must be initiated within two years of the incident. All claims are subject to mandatory arbitration within Oregon, with the venue being the Circuit Court.

You must be at least 16 years old to access or use this website and must agree to these terms.

No content from the Sophie's Stems website may be copied or reproduced without express permission.

II. Using an Account at Sophie's Stems

  • You must be 16 years or older.
  • You must agree to the terms of this Agreement.
  • You may not register or place orders on behalf of someone else without their consent.
  • If you share your login credentials with others, you are responsible for any actions taken under your account.

III. Purchasing Products

You must be at least 16 years old to purchase products from our website.
By completing a purchase, you acknowledge and agree to these Terms and Conditions.

IV. Delivery Policy

In addition to our local delivery network, we may use UPS, FedEx, and USPS to ship floral arrangements and gift products.

  • Minimum order: We do not fulfill deliveries under $29.99.
  • Same-day delivery: Orders must be placed before 2 PM local time.
  • Orders placed after 2 PM will be delivered the next business day.
  • Sunday orders are scheduled for delivery the following Monday.
  • Typical delivery hours are 9 AM – 7 PM local time.

Holiday Deliveries
We cannot guarantee delivery on peak floral holidays such as Valentine's Day, Thanksgiving, and Christmas. Please order at least 4 days in advance to ensure timely delivery.

Undeliverable Locations
We do not deliver to certain locations, including but not limited to:

  • Cemeteries
  • Cruise ships
  • Airport terminals
  • P.O. boxes
  • Remote or rural addresses

Delays and Missed Deliveries
We will make every reasonable effort to contact you in case of delays due to:

  • Incorrect or incomplete delivery address
  • Road closures, traffic conditions, or weather
  • Inaccessible or unsafe delivery conditions

If delivery cannot be completed:

  • We will reschedule for the next available time.
  • If no one is home, our driver may call the recipient. If unreachable, the order may be left at the door unless weather or safety is a concern. In that case, it will be returned to the shop and reattempted the next business day.

Non-delivery Claims must be submitted within 48 hours of the intended delivery date.

V. Service Fees

  • Delivery fees apply and are displayed during checkout.
  • Additional charges may apply for rural deliveries; customers will be notified in advance.
  • Refused orders are not eligible for refund.

VI. Substitution Policy

We strive to deliver your order exactly as requested. However, due to seasonal availability:

  • Containers/Vases may be replaced with a similar item of equal or greater value.
  • Flowers may be substituted with similar varieties to maintain overall look and value.
  • Gift items may be replaced with similar items within the same category and value range.

VII. Cancellations

  • Orders may be canceled within 24 hours of placement.
  • Same-day and next-day deliveries cannot be canceled once processed.

VIII. Copyright and Trademarks

All content on the Sophie's Stems website is protected under U.S. copyright laws.
The website and its materials are for personal use only and may not be copied, reproduced, or redistributed without written consent.

IX. Indemnification

By using this website, you agree to indemnify and hold harmless Sophie's Stems, its owners, employees, agents, affiliates, and partners from any claims, liabilities, damages, or costs arising from your use of the site or any violation of this Agreement.

You agree to cooperate fully in the defense of any such claims.
